Cryptocurrency trading involves substantial risk of loss and is not suitable for every investor. The valuation of cryptocurrencies may fluctuate, and as a result, clients may lose more than their original investment. ApexNode is a software tool, not a financial advisor.

1. Acceptance of Terms

By accessing or using the ApexNode website and trading algorithms, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

ApexNode provides automated algorithmic trading software ("Bots") that interacts with cryptocurrency exchange APIs. You acknowledge that:

  • The Software executes trades automatically based on pre-set parameters.
  • Past performance of any trading system or methodology is not necessarily indicative of future results.
  • We do not have custody of your funds at any time.

3. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account login and wallet keys.
  • Ensuring your API keys are set to "Trade Only" and never "Withdraw".
  • Ensuring that your use of the Service complies with the laws of your local jurisdiction.

4. Subscription and Payments

ApexNode offers a free 7-day trial. Following the trial, continued use requires a paid subscription. Payments are processed via cryptocurrency (Smart Contract). All payments are final and non-refundable, except where required by law.

5. Limitation of Liability

To the maximum extent permitted by applicable law, ApexNode Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your use or inability to use the Service.
  • Unauthorized access to our servers.
  • Market volatility or exchange downtime (e.g., Binance going offline).
  • Bugs or errors in the algorithmic code, although we strive for perfection.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms (e.g., attempting to reverse engineer the software).

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
